ТЕЛЕСНО И МЕНТАЛНО ЗДРАВЉЕ ИЗВРШИЛАЦА КРИВИЧНИХ ДЕЛА ПРОТИВ ЖИВОТА И ТЕЛА/PHYSICAL AND MENTAL HEALTH OF THE EXECUTORS OF CRIMES AGAINST LIFE AND BODY

Abstract

Целовито и суштинско сагледавање кривичних дела против живота и тела као индивидуалне појаве, поред минуциозне анализе личности извршилаца, мора да инкорпорира и сазнања о њиховом телесном и менталном здрављу. С обзиром да смо се личношћу извршилаца већ детаљно бавили, определили смо се да у раду који следи фокусирамо пажњу на улогу коју у манифестовању овог вида криминалног понашања имају проблеми на плану њиховог телесног и менталног функционисања. Према резултатима истраживања, најинтензивнији криминогени утицај остварују: телесни недостаци; алкохолизам/алкохолисаност tempore criminis; психопатије; дебилитет и схизофренија. Наведени проблеми нису непосредни узрок криминалног понашања, тј. не доводе аутоматски до вршења кривичних дела. Веза између њих и кривичних дела којима се повређује или угрожава туђи живот, односно телесни интегритет, несумњиво постоји, али је по својој природи друштвена и индиректна. Очигледно је да сазнања о личности извршилаца ових кривичних дела, као и о нарушености њиховог здравља представљају неопходну претпоставку за: а) разумевање механизма деловања друштвених утицаја који своје дејство на понашање појединаца никада не остварују директно, већ посредством и на основу личних својстава (дакле, постоји дијалектичка повезаност објективног и субјективног); б) осмишљено планирање, организовање и предузимање превентивних активности и в) правилно решавање питања кривице и остваривање начела индивидуализације кривичне санкције, како приликом њеног изрицања, тако и у фази третмана и ресоцијализације.

A comprehensive and substantive examination of crimes against life and body as an individual phenomenon, in addition to the minuscule analysis of the perpetrators' personality, must incorporate knowledge of their physical and mental health. Considering that we have already dealt with the personality of the executors, we have decided that in the exposed work we focus attention on the role that in the manifestation of this type of criminal behavior has problems in terms of their physical and mental functioning. According to the results of the research, the most intense criminological effect is achieved by: physical defects; alcoholism/alcoholism tempore criminis; psychopathy; obesity and schizophrenia. These problems are not the direct cause of criminal behavior, i.e. do not automatically lead to the commission of criminal offenses. The connection between them and the crimes that injure or endanger someone else's life or body integrity undoubtedly exists, but by its very nature is social and indirect. It is obvious that the knowledge about the personality of the executors of these crimes, as well as the impairment of their health, is a necessary precondition for: a) understanding the mechanism of the functioning of social influences which never exercise their effect on the behavior of individuals directly but through and on the basis of personal characteristics (that is, there is a dialectical connection between objective and subjective); b) planned planning, organization and undertaking of preventive activities; and c) proper resolution of the issue of guilt and realization of the principle of individualization of the criminal sanction, both during its pronouncement and in the stage of treatment and resocialization.
