ПОСТУПАК ЈАВНЕ ПРОДАЈЕ ЕЛЕКТРОНСКИМ ПУТЕМ/AN ELECTRONIC PUBLIC SALE PROCEDURE

Abstract

У поступку извршења на непокретностима, покретним стварима и заједничком продајом непокретности и покретних ствари, једна од извршних радњи је продаја предмета извршења. Уобичајен начин уновчавања ствари ради намирења новчаног потраживања извршног повериоца представљало је усмено јавно надметање, које је Законом о изменама и допунама Закона о извршењу и обезбеђењу из 2019. године замењено електронским јавним надметањем. Од септембра месеца 2020. године, продаја непокретности, покретних ствари и њихова заједничка продаја врши се искључиво електронским путем, преко портала електронског јавног надметања. У раду су анализиране одредбе којима су регулисани поступак, организација и ток поступка јавне продаје електронским путем, указано је на значај овог новог законског решења али и на недостатке важећих правила.

In the procedure of enforcement on real estate, movable property and by a joint sale of real estate and movable property, one of the enforcement actions is the sale of the subject of enforcement. A usual way of encashing objects in order to settle a monetary claim of the executive creditor used to be an oral public bidding which was replaced by an electronic public bidding by the Law on Amendments to the Law on Enforcement and Security in 2019. Since September 2020, the sale of real estate, movable property and their joint sale have been conducted electronically using the portal for electronic public bidding. The provisions regulating the procedure, organization and course of the procedure of an electronic public sale have been analyzed in the paper. The following has been explained: which way and by whose initiative an electronic public bidding is scheduled, the way of applying for an electronic public bidding, the way a bid is offered and when it comes to a suspension or stoppage of an electronic public sale procedure. The contents of the minutes on a conducted electronic public bidding have also been analyzed. The author in the paper points to the significance of this new legal solution and the motives for its introduction but also to the shortcomings of the applicable rules.
